Terms of Service — Dualex

1. Acceptance of Terms

By downloading, installing, or using the Dualex application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Dualex is a language learning platform offering:

• CEFR-aligned academic lessons (A1.1 through C2.2).
• Everyday natural spoken language ("everyday language") lessons (S1 through S5).
• AI-powered placement tests and homework generation.
• SM-2 spaced repetition flashcard review.
• Text-to-Speech pronunciation (Google Cloud Wavenet).
• Practice exams with scoring.

The App supports multiple language pairs including German, English (US), and English (UK) with native-language explanations in Arabic, English, and German.

3. User Accounts

• You must create an account using a valid email address.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must verify your email address before accessing lesson content.
• You may delete your account at any time from the Profile screen. All associated data will be permanently deleted within 30 days.

4. Subscriptions & Payments

Free Tier: All A1.1 and S1 lessons are free. Limited daily reviews and basic TTS.

Pro Subscription: Unlocks all academic and everyday language lessons across all CEFR levels (A1.1–C2.2), unlimited daily reviews, all exams, and full TTS voice selection.

Pro Max Subscription: Includes all Pro features plus AI Street Mentor (voice-based everyday language practice), unlimited TTS, and priority support.

Billing:

• Subscriptions are billed through Google Play (Android) or Apple App Store (iOS).
• Payment is charged to your account upon confirmation of purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your device's account settings.

Refunds: Refund requests are handled by Google Play or Apple App Store according to their respective policies. Dualex does not process refunds directly.

5. Content & Intellectual Property

• All lesson content (academic and everyday language), exam questions, and AI-generated materials are the intellectual property of Dualex.
• You may not reproduce, distribute, or create derivative works from Dualex content without explicit permission.
• The Dualex name, logo, and branding are trademarks of Dualex.

6. User Conduct

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to access another user's account or data.
• Reverse-engineer, decompile, or extract the App's source code.
• Use automated tools (bots, scrapers) to access the App.
• Upload or share any content that is offensive, harmful, or violates intellectual property rights.

7. Third-Party Services

The App integrates with:

• Firebase (Google LLC) for authentication, data storage, and cloud functions.
• Google Cloud Wavenet for Text-to-Speech.
• OpenAI (via Cloud Function proxy) for AI-generated content.

Dualex is not responsible for the availability or content of third-party services.

8. Limitation of Liability

Dualex is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation of the App.
• Accuracy of AI-generated content (placement tests, homework).
• Permanent availability of lesson content.

To the maximum extent permitted by law, Dualex shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time by deleting it from the Profile screen.

10. Governing Law

These Terms are governed by the laws of Egypt. Any disputes shall be resolved in the courts of Cairo, Egypt.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the App. Continued use of the App after changes constitutes acceptance of the new Terms.

Zustimmung zum sofortigen Vertragsbeginn (§ 356 Abs. 5 BGB)

Vor Abschluss eines kostenpflichtigen Abonnements werden Sie in der App aufgefordert, den folgenden beiden Punkten ausdrücklich zuzustimmen:

1. Ich stimme ausdrücklich zu, dass Dualex (Tawfik Abdelaal) sofort nach Vertragsschluss mit der Bereitstellung der digitalen Inhalte beginnt. Mir ist bekannt, dass ich meinen Zugang unmittelbar nach Zahlungsabschluss erhalte.
2. Ich bestätige ausdrücklich, dass ich Kenntnis davon habe, dass mein 14-tägiges Widerrufsrecht erlischt, sobald Dualex mit der Vertragsausführung beginnt.

Ohne Ihre Zustimmung können wir den Zugang nicht sofort freischalten.

CEFR-Hinweis / GER-Einordnung

§ X — Einordnung der Lernstufen und kein Zertifikatsanspruch

(1) Die in der Anwendung verwendeten Stufenbezeichnungen (A1.1 bis C2.2) orientieren sich am Gemeinsamen Europäischen Referenzrahmen für Sprachen (GER). Diese Einteilung dient ausschließlich der groben Orientierung und der Binnenstrukturierung der Lerninhalte.

(2) Dualex ist kein zertifizierter Sprachkurs im Sinne einer staatlich anerkannten Bildungseinrichtung. Die Nutzung der Anwendung bereitet nicht auf eine bestimmte externe oder staatliche Prüfung vor und ersetzt keinen zertifizierten Sprachunterricht.

(3) Dualex stellt keine Zeugnisse, Zertifikate, Diplome oder sonstige Qualifikationsnachweise aus. Die in der Anwendung angezeigten Punktzahlen und Fortschrittsanzeigen dienen ausschließlich der Selbstkontrolle des Nutzers und begründen keinen Anspruch auf eine bestimmte Sprachniveaustufe.

(4) Die Einteilung der Lerninhalte in Stufen erfolgt nach redaktionellem Ermessen des Anbieters. Sie stellt keine verbindliche Einstufung nach dem GER durch eine autorisierte Stelle dar.
